“Contest” means the contest called the Joinourcommunitydraw as further described herein;
“Contest Rules” means these rules and any other requirements of law;
“Participant” means an individual who has entered the Contest, as described below;
“Prize” means ONE (1) of the cocktail bar sets, as described further herein.
This Contest is open to all legal residents of Canada who have reached the legal drinking age in their province or territory of residence, as of the date of entry into the contest. The Contest is limited to residents of Canada. Employees, agents, representatives and mandataries of Spirits Canada and those with whom they are domiciled are not eligible to enter the Contest. Entries may not be made in the name of a minor.
3. THE PRIZES AND APPROXIMATE RETAIL VALUE:
The Prizes consist of FOUR (4) cocktail bar sets, with the approximate value of $125.00 CAD, each. Prize value is based on retail value at time of publication of the Contest Rules. ONE (1) prize will be awarded per each yearly quarter. A winner will be drawn on the following dates: September 30, December 31, March 31, and June 30.
The Prizes will be awarded in accordance with the process set out herein, and must be accepted as awarded. No substitutions or cash alternatives will be permitted. The Prizes are non-transferrable. Participants will be required to comply with all the Contest Rules.
4. ENTRY REQUIREMENTS:
Contest entry ballots are available and must be submitted electronically at www.spiritscanada.ca. To enter the Contest, Participants will be required to complete an online Contest ballot (an “Entry”) with their name and contact information so that they may be contacted if they are a winner. Entries must be received five (5) business days prior to the draw date. There is no fee to enter the Contest and no purchase is necessary.
In the event that a Participant does not complete an Entry, they will not be eligible to be a winner. Spirits Canada is not responsible for late, lost, misdirected, delayed, or illegible Entries. Incomplete or incorrect Entries and Entries with falsified or inaccurate information will be disqualified. The decision to disqualify any Entry is at the sole discretion of Spirits Canada, and will occur without notice or communication to the entrant. The decision to disqualify an Entry is final and not subject to review.
5. WINNER SELECTION:
Spirits Canada shall draw from all completed Entries and randomly select one (1) Participant to receive the Prize, per yearly quarter, throughout Canada. Spirits Canada will contact the winner via e-mail within six (6) business days of the draw date. Once an entry is selected, the winner must correctly answer a skill testing question in order to be deemed an official winner and receive the Prize. The winner agrees to sign Spirits Canada’s form of Winner’s Waiver and Release of Liability, attached hereto as Schedule “A”, as a condition of receiving the Prize.
In the event the winner cannot be contacted or does not respond to such contact within 30 days of notification, the winner will be deemed to have declined the Prize and another Participant will be randomly selected by draw from all other eligible entries received (a “Secondary Winner”), who shall also be contacted by e-mail and have 30 days to respond to such contact. The Secondary Winner will need to correctly answer a skill testing question in order to be deemed an official winner and receive the Prize. This process will continue until a Participant has correctly answered the skill testing question and has accepted the Prize.
The Prize must be collected by the winner at Toronto, Ontario within 60 days of the draw date, failing which a Secondary Winner will be selected.
Spirits Canada is not responsible for any inability to locate or contact a winner; for the failure, for any reason whatsoever, of a potential winner to receive notification; or, for failure for any reason for Spirits Canada to receive a potential winner’s response.
The odds of winning depend upon the number of eligible Entries received.
7. TERMINATION OF CONTEST:
Spirits Canada reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including without limitation any virus, error, technical problem, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of Spirits Canada that interferes with the proper conduct of this Contest as contemplated by these rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, Spirits Canada reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Spirits Canada reserves the right to cancel or suspend this Contest in the event of any accident, printing, administrative, or other error of any kind without prior notice and without obligation.
8. GENERAL TERMS AND CONDITIONS
For Residents of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement
All entries and/or Participants not complying with any of the Contest Rules will be disqualified.
No correspondence will be entered into except with the selected winners. The Contest is subject to all applicable federal, provincial, and municipal laws. The decisions of Spirits Canada with respect to all aspects of the Contest are final and binding on all Participants without right of appeal.
By entering this Contest, Participants agree to comply with these official Contest Rules and agree to the publication, reproduction, and/or other use of their entry and their name, address, voice, statements about the Contest, and/or personal photograph or other likeness without further compensation, in any publicity or advertisement carried out by Spirits Canada in any manner whatsoever, including print, broadcast, or the internet.
By entering this Contest, each Participant expressly consents to Spirits Canada, its agents and/or representatives, storing, sharing, and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with applicable privacy law. By entering the draw, the participant agrees to allow Spirits Canada to contact them with periodic updates and information related to the regulation and taxation of beverage alcohol in Canada.
Without limitation, Spirits Canada will not be liable for the failure of any entry to be received or for any technical or other problems in the administration of the Contest. By entering the contest, each Participant (a) releases and holds harmless Spirits Canada and its respective directors, officers, employees, affiliates, suppliers, sponsors and agents from any and all liability for any injuries, loss or damage of any kind to persons or property, including death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prizes, participation in the contest, or participating in any prize related activity; and (b) agrees to fully indemnify Spirits Canada and its respective directors, officers, employees, affiliates, suppliers, sponsors and agents from any and all claims from third parties without limitation.

Contest void where prohibited by law.
It is the express wish of the parties that this Agreement and all related documents, including notices and other communications, be drawn up in the English language only.
